Purpose

Pursuant to 31 U.S.C. § 3726(g), this Order implements a delegation of authority from the Administrator of General Services to all Federal agencies to exercise all authorities conferred by Section 3726, subject to the limitation below,
including the authorities to audit transportation bills, make deductions from those bills, and adjudicate related claims.

Cancellation

This Order supersedes ADM 5450.182 any other previous Order concerning the delegation of any authority under 31 U.S.C. § 3726. 

Background

Pursuant to 31 U.S.C. § 3726(g), the Administrator of General Services may delegate any authority conferred by this section to another agency or agencies if the Administrator determines that such a delegation would be cost-effective
or otherwise in the public interest. The Administrator has determined that this delegation will be cost-effective and in the best interest of the public.

Delegation of Authority

Effective immediately, all authorities conferred by 31 U.S.C. § 3726, subject to the limitation below, are delegated to the respective Federal agency where the transportation invoice was paid. GSA expects that Federal agencies exercising authorities delegated by this Order will treat the regulations codified at 41 CFR § 102-118, which refer to the ‘GSA Transportation Audits Division,’ as referring to those agencies instead. To the extent that it is required, this delegation serves as an exemption under 41 CFR § 102-118.420 permitting agencies to conduct post-payment audits.

  1. Limitation

    The authority granted to the Administrator by 31 U.S.C. § 3726(g) to delegate these authorities to another agency is not included in this delegation, but agencies may delegate the authority internally consistent with their own authorities, including delegations to agencies or subcomponents within the same parent agency. An agency may enter into an agreement with another Federal agency to provide adjudication services on their behalf. 

  2. Nonexclusivity

    This delegation permits other Federal agencies to exercise the authorities conferred by Section 3726. GSA reserves the right to exercise these authorities. Currently, GSA has no plans to exercise its powers under Section 3726 and anticipates that other Federal agencies will exercise those powers.

Implementing Actions

  1. The changes outlined in this Delegation of Authority become effective upon signature.
  2. The officials designated in this Order, in conjunction with other appropriate officials, shall take all necessary actions to implement this order. The GSA Delegations of Authority Manual will be updated at a later date.
