Regulatory compliance
According to FAR Part 12 and FAR Subpart 9.1, our contracts protect the government by ensuring offerors
- Have adequate financial resources to perform the work anticipated
- Can meet the delivery or performance requirements
- Have a satisfactory performance record
- Have a satisfactory record of integrity and business ethics
- Have the corporate facilities, resources, equipment, skills, and controls to do the work
- Are otherwise qualified and eligible to receive a contract award under federal laws and regulations
- Are TAA-compliant regardless of order value
- We also evaluate offerors’ corporate experience, past performance, and quality control
Fair and reasonable prices
Our contracting officers make sure that prices of supplies, fixed-price services, and rates for services offered at hourly rates are fair and reasonable. We determine fair and reasonable pricing by looking at factors like competitor contracts, historical prices, current prices from other sources, and corporate benchmarks.
Most of the time, you don’t need to get cost or pricing data, especially when placing an order under a GSA MAS blanket purchase agreement. In fact, the Federal Acquisition Streamlining Act discourages duplicating this effort.
Exceptions
If you are buying services under the MAS, you still need to ensure the level of effort and mix of labor are appropriate, according to FAR 8.405-2(d). Buyers from the Department of Defense and NASA also need to make a determination of fair and reasonable pricing according to FAR 8.404(d).
To do this, your offerors must use the MAS solicitations list and provide the following
- A complete price proposal template
- A written justification for the offered price
- A mechanism for future potential pricing adjustments
- Proof that the price is fair and reasonable (but we will negotiate and make the final determination of that)
Tier 2 spending
Our program is Tier 2, which describes spending managed at a governmentwide level through multi-agency or governmentwide solutions that aren’t best in class, but that reflect strong contract management practices. This program includes sharing data and information across agencies and using cross-agency metrics.
Faster buying
Besides some exceptions, our general, competitive (fair opportunity) MAS orders and BPAs are not synopsized at SAM.gov. You can buy commercial supplies and services using our streamlined ordering procedures, which is faster than using open-market procedures. These buys are compliant with the Competition in Contracting Act when you use FAR Subpart 8.4 ordering procedures.
Vast supplies and services
We continuously onboard new contractors to make sure we have new and innovative solutions with the best that industry has to offer the government. In general, new contractors can submit offers at any time.
Our contract periods of performance have a base period that starts at the date of the award and lasts five years. Then we have three five-year options, which means our contracts can be available for up to 20 years.
Our contracts fit into one of three categories of geographic coverage
- Domestic includes all U.S. states and territories, plus Washington D.C.
- Overseas includes only overseas destinations
- Worldwide includes domestic and overseas
